These Terms of Service govern the relationship between Tax Credit Genie, LLC (“we,” “our,” or “us”) and any organization (“you” or “your”) that advertises or receives donations through the website https://aztaxcreditfunds.com. By participating in our platform, you agree to the following terms.

1. Platform Overview

AZ Tax Credit Funds is a 501(c)(3) nonprofit organization that provides the website as a platform for facilitating Arizona tax credit donations. Tax Credit Genie, LLC manages all advertising agreements and organizational onboarding related to the site.

2. Eligibility and Compliance

You are responsible for maintaining active and verified status with the Arizona Department of Revenue as a Qualified Charitable Organization (QCO) or Qualified Foster Care Charitable Organization (QFCO).

• You must notify Tax Credit Genie, LLC immediately if your qualified status changes or is revoked.
• You agree to comply with all applicable Arizona laws and regulations governing tax credit donations.

3. Donor Receipts

You are solely responsible for issuing official donation receipts to donors for tax reporting purposes.

• Receipts must meet Arizona Department of Revenue requirements.
• AZ Tax Credit Funds and Tax Credit Genie, LLC do not issue receipts on your behalf.

4. Advertising Agreement

You agree to:

• Pay the advertising fee as outlined in your signed agreement with Tax Credit Genie, LLC for the duration of the selected term.
• Provide all required graphics, logos, and promotional materials during the onboarding process.
• Ensure that submitted content is accurate, current, and appropriate for public display.

5. Donation Processing

Donations made to your organization through the AZ Tax Credit Funds platform are processed via FINIX, a third-party payment processor.

• Funds are deposited directly into a bank account owned and controlled by your organization.
• AZ Tax Credit Funds and Tax Credit Genie, LLC do not have access to or control over these funds at any time.
• A 3% processing fee per transaction is charged by and paid to FINIX.
• Neither AZ Tax Credit Funds nor Tax Credit Genie, LLC retains any portion of the donation.

6. Content and Intellectual Property

You grant Tax Credit Genie, LLC and AZ Tax Credit Funds permission to display your organization’s name, logo, and promotional materials on the website and related communications.

• You affirm that you have the rights to all submitted content.
• We reserve the right to remove or modify content that is inaccurate, outdated, or inconsistent with our mission.

7. Termination

Tax Credit Genie, LLC reserves the right to suspend or terminate your participation if:

• You fail to maintain qualified status with the Arizona Department of Revenue.
• You breach any terms outlined in this agreement.
• You engage in conduct that may harm the integrity or reputation of AZ Tax Credit Funds or Tax Credit Genie, LLC.

8. Limitation of Liability

Tax Credit Genie, LLC and AZ Tax Credit Funds are not liable for:

• Errors in donation processing by FINIX.
• Tax outcomes for donors.
• Any loss or damages resulting from your use of the platform or failure to comply with these terms.

9. Updates to Terms

We may update these Terms of Service periodically. Continued participation constitutes acceptance of any changes.
